Bar Council Issues Show Cause Notices Following Alleged Attack on Adv. Gaurav Bhatia

In a disturbing turn of events, the Bar Council of India (BCI) has taken swift action following an alleged attack on senior advocate Gaurav Bhatia during a lawyers’ strike at the Gautam Budh Nagar District & Sessions Court. The incident, which unfolded yesterday, has prompted the issuance of show cause notices to the President and General Secretary of the Ghaziabad Bar Association.

Gaurav Bhatia, who was present at the court premises to handle an urgent bail matter, found himself barred from entry due to the ongoing boycott by local lawyers. Amidst the chaos, Bhatia and a female colleague were reportedly subjected to physical assault, with one junior lawyer even snatching Bhatia’s wristband.

In response to the distressing ordeal, Bhatia promptly reached out to the BCI Chairman, apprising him of the situation. The BCI has wasted no time in initiating disciplinary proceedings, calling upon the Bar Association’s President and General Secretary to furnish explanations by March 27, elucidating why their licenses to practice should not be suspended.

Describing the incident as prima facie evidence of gross professional misconduct, the BCI issued a stern statement condemning such behavior. The council emphasized the paramount importance of upholding the integrity of the legal profession and ensuring unhindered access to justice. Any deviation from the highest standards of integrity and ethical conduct, the BCI underscored, warrants disciplinary action.

The BCI has scheduled a hearing on March 28, at 2 PM, conducted through a hybrid mode, wherein the office bearers of the Bar Association will have the opportunity to present their case. Additionally, Gaurav Bhatia has been invited to participate in the proceedings, ensuring all perspectives are duly considered.

Meanwhile, the Supreme Court has also intervened, taking suo motu cognizance of the incident. In a directive to the concerned District Judge, the apex court has mandated the preservation of CCTV footage capturing the altercation, pending further orders.
