J&K Govt seeks details of employees who can be retired under new rules

The order has directed the DCs of several districts in Kashmir to forward the details within five days.

The Jammu and Kashmir UT administration has sought the details of employees who can be retired under new rules from the Deputy Commissioners (DCs) in Kashmir division.

The government employees who have attained 48 years of age or have completed 22 years of service can be retired by the government under new rules applicable in the Union territory.

According to local media reports, a letter by Private Secretary to Divisional Commissioner, Fayaz A. Khan under number DivCom/PS/Misc/2020/3126; Dated: 12-02-2021 directed the DCs to submit the details of the employees who have attained 48 years of age or have completed 22 years of service or more (as on ending December 2021).

The order has directed the DCs of Srinagar, Ganderbal, Anantnag, Budgam, Kulgam, Shopian, Baramulla, Bandipora, Kupwara and Pulwama districts to forward the details within five days.

“Kindly find enclosed herewith data/details of employees who have attained 48 years of age or more and completed 22 years of service or more (as on ending December 2021) provided by your office. Information of these employees may be forwarded to this office (soft/hard copy) within 05 days positively in the enclosed excel format for further course of action,” the letter reads.

“Besides, it may be ensured that no such employee who falls in the category is left out,” it said, adding that the matter may be treated as most urgent.

To put the latest directive of the UT administration in context, it is important to mention that Jammu and Kashmir’s new Civil Service Regulation Rules were amended on October 22, 2020, to allow the administration to retire government employees at any time after either completing 22 years of service or attaining the age of 48 years.

The employees can be retired after being given three months’ notice or three months’ of pay and allowance in lieu of the notice.

On the orders of Lieutenant Governor Manoj Sinha, the administration had introduced certain substitutes in Article 226(2) of Jammu and Kashmir Civil Service Regulations.

A notification was issued by Finance Department in this regard, which stated that in the exercise of powers conferred under the provision to Article 309 of Indian Constitution, Lieutenant Governor has directed that Article 226(2) of Jammu and Kashmir Civil Service Regulations may be substituted as “226 (2): (a) Notwithstanding anything contained in these Regulations, the government may, if it is of the opinion that in the public interest to do so, require any government employee other than one working on a post which is included in Schedule II of these rules, to retire at any time after he/she has completed 22 years of qualifying service or on attained 48 years of age.”

The notification, however, said the employee can be retired provided the appropriate authority gives a notice at least three months before the date on which he/she is required to leave or three months of pay and allowance in lieu of such a notice.
